Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Live12 DB API, websites and related services (collectively, the “Service”) provided by Live12 DB B.V. (“Live12 DB”, “we”, “us”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be capable of forming a binding contract to use the Service. You are responsible for the activity that occurs under your account and for keeping your API keys confidential. Notify us promptly of any unauthorized use.

2. Use of the Service

We grant you a limited, non-exclusive, non-transferable right to access the Service in accordance with these Terms, your plan, and our Acceptable Use Policy. You may not resell, sublicense, or redistribute bulk extracts of the data except as expressly permitted by your plan.

3. Plans, fees & quotas

Paid plans are billed in advance on a recurring basis. Usage quotas and rate limits apply per plan and are enforced via response headers. Fees are non-refundable except where required by law. We may change pricing with reasonable prior notice.

4. Service levels & changes

Service availability commitments, if any, are set out in your plan. We may modify, suspend, or discontinue parts of the Service. Where a change is material and adverse, we will use reasonable efforts to provide advance notice. Datasets are versioned; breaking changes are introduced under new versioned paths.

5. Intellectual property

The Service, including software, documentation, and the compilation and curation of datasets, is owned by Live12 DB or its licensors and is protected by applicable laws. No rights are granted other than those expressly stated in these Terms.

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Reference data is provided for informational purposes and may contain inaccuracies; you are responsible for validating it for your use case.

7. Limitation of liability

To the maximum extent permitted by law, Live12 DB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our aggregate liability arising out of or related to the Service will not exceed the amounts you paid to us in the twelve months preceding the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or the Acceptable Use Policy, or where required by law. Upon termination, your right to access the Service ceases.

9. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. The courts located in Amsterdam will have exclusive jurisdiction, subject to any mandatory consumer protections.

10. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use of the Service after changes take effect constitutes acceptance.
